FACT SHEET FOR H.B. 2200

 

professional registration; reciprocity; endorsement

Purpose

Outlines the qualifications for registration with the Arizona Board of Technical Registration (AZBTR) as a professional engineer, architect, land surveyor or landscape architect in Arizona through reciprocity or endorsement.

Background

The AZBTR is established with the purpose of providing for the safety and welfare of the public through the promulgation and enforcement of standards of qualification for certain technical professions and occupations, including architects, engineers, landscape architects and land surveyors (A.R.S. § 32-101).

A person desiring to practice any AZBTR-regulated profession or occupation must apply for registration or certification on a form and accompanied by the appropriate application fee prescribed by the AZBTR, subscribed under penalty of perjury. An applicant for professional registration as an architect, engineer, geologist or landscape architect must be actively engaged in education or experience, or both, in the profession for which registration is sought for at least eight years. An applicant for professional registration as a land surveyor must be actively engaged in education or experience, or both, in the profession for which registration is sought for at least six years. All applicants must pass the applicable in-training and professional examinations in the profession in which registration is sought, with prescribed exemptions (A.R.S. §§ 32-122.01; 32-123; and 32-126).

There is no anticipated fiscal impact to the state General Fund associated with this legislation.

Provisions

1.   States that a person who meets the qualifications for registration in accordance with reciprocity or endorsement requirements is eligible for registration as a professional engineer, architect, land surveyor or landscape architect in Arizona.

2.   Requires an applicant for registration as a professional engineer, architect, land surveyor or landscape architect in Arizona through reciprocity or endorsement to hold both:

a)   a valid license, registration or certification issued by the proper authority of either another state, territory, district or possession or a country participating in the applicable profession's national council mutual recognition agreement; and

b)   a certification or model law designation from the applicable profession's national council.

3.   Requires, as an additional requirement, an applicant for registration as a professional engineer through reciprocity or endorsement to hold a record from the profession's national council verifying that the person meets at least one of the following in the branch of engineering in which registration is sought:

a)   has at least four years of experience following the person's licensure, registration or certification by the other jurisdiction;

b)   passed a professional national examination; or

c)   earned a baccalaureate or equivalent degree or a postgraduate degree.

4.   Requires, as an additional requirement, an applicant for registration as a land surveyor through reciprocity or endorsement to pass the examination relating to surveying methods and legal principles in Arizona as prescribed by AZBTR in rule.

5.   Becomes effective on the general effective date.
