municipal separate storm sewer system
Purpose
Modifies the definition of county as it relates to local stormwater quality programs to include counties that operate a regulated medium or large separate storm sewer system, rather than just a small municipal separate storm sewer system.
Background
The Arizona Pollutant Discharge Elimination System Program (AZPDES) establishes permitting requirements for discharges to Waters of the U.S. (WOTUS) consistent with the Clean Water Act (A.R.S. § 49-255.01). A county that operates a small municipal separate storm sewer system that discharges to a federally protected surface water must comply with the National Pollution Discharge Elimination System (NDPDES).
A county that is required by the Clean Water Act to obtain coverage under a national or state pollutant discharge elimination system stormwater program or a county that is required to obtain coverage under a AZPDES permit can: 1) develop and implement stormwater pollution prevention plans and stormwater management programs; and 2) adopt, amend, repeal and implement any ordinances, rules or regulations necessary to comply with the minimum requirements of the Clean Water Act or AZPDES.
County means a county that operates a regulated small municipal separate storm sewer system. For small municipal separate storm sewer systems that discharge to non-WOTUS protected surface waters, this definition must apply as if the small municipal separate storm sewer system discharged to a WOTUS protected surface water (A.R.S. § 49-371).
There is no anticipated fiscal impact to the state General Fund associated with this legislation.
Provisions
1. Modifies the definition of county as it relates to local stormwater quality programs to include counties that operate a regulated medium or large separate storm sewer system, rather than just a small municipal separate storm sewer system.
2. Makes conforming changes.
3. Becomes effective on the general effective date.
