electric vehicle charging stations; report

Purpose

Requires the number of designated parking spots for and the location of electric vehicle charging stations approved for public use to be reported to the Arizona Department of Transportation (ADOT).

Background

The National Electric Vehicle Infrastructure (NEVI) Formula Program is a $5 billion Program managed by the Federal Highway Administration to fund a resilient, equitable, accessible and reliable national network of electric vehicle fast charging stations along the nation’s highways. To qualify for funding, electric vehicle charging stations must be placed no more than 50 miles apart and within one mile of a highway and each station must have at least four electric vehicle parking spaces. In late 2024, the first 18 stations were conditionally awarded to the State of Arizona and construction is expected to begin at the end of 2025 (ADOT).

An electric vehicle is a motor vehicle that is either partially or fully powered on electric power received from an external power source and does not include golf carts, electric bicycles or other micromobility devices. A charging station is the area in the immediate vicinity of a group of chargers and includes the chargers, supporting equipment, parking areas adjacent to the chargers and lanes for vehicle ingress and egress (23 C.F.R. § 680.104).

               There is no anticipated fiscal impact to the state General Fund associated with this legislation.

Provisions

1.   Requires an entity, county, municipality or state agency that approves or permits an electric vehicle charging station for public use on its property to report as soon as practicable to ADOT:

a)   the location of the electric vehicle charging station; and

b)   the total number of parking spots designated for electric vehicle charging.

2.   Requires, by December 31, 2025, and once every quarter thereafter, the Director of ADOT to:

a)   compile a list of all electric vehicle charging stations in Arizona; and

b)   provide a report to the President of the Senate and the Speaker of the House of Representatives.

3.   Requires the report reflect any new or decommissioned electric vehicle charging locations.

4.   Defines an entity as any business that provides for the use of electric vehicle charging stations on the business's property.

5.   Becomes effective on the general effective date.
