ARIZONA STATE SENATE
Fifty-Seventh Legislature, First Regular Session
for-sale housing; development; groundwater replenishment
Purpose
Expresses the Legislature's support for allowing for-sale housing developments to be built outside of the service area of a designated provider if the development is enrolled in the Central Arizona Groundwater Replenishment District (CAGRD) and the groundwater used to serve such homes is replenished.
Background
For each active management area (AMA) in which CAGRD member lands or member service areas are or may be located, CAGRD must replenish groundwater in an amount equal to the groundwater replenishment obligation for that AMA. CAGRD must complete the replenishment of groundwater replenishment obligation of that AMA within three full calendar years after the year that CAGRD incurs the replenishment obligation. Replenishment of the groundwater replenishment obligation of an AMA is complete when the amount of water added to aquifers through water storage equals or exceeds the groundwater replenishment obligation of the AMA for that year (A.R.S. § 48-3771).
There is no anticipated fiscal impact to the state General Fund associated with this legislation.
Provisions
· Declares that the Legislature supports allowing for-sale housing developments to be built outside the service area of a designated provider, if the development is enrolled in CAGRD and the groundwater used to serve such homes is replenished in compliance by the Phoenix, Pinal and Tucson AMA Assured Water Supply Rules.
