AN ACT

 

Amending title 28, Chapter 25, Arizona Revised Statutes, by adding article 9; Relating to Aviation.

Be it enacted by the Legislature of the State of Arizona:

Section 1. Title 28, chapter 25, Arizona Revised Statutes, is amended by adding article 9, to read:

ARTICLE 9. ADVANCED AIR MOBILITY INFRASTRUCTURE

START_STATUTE28-9001. Definitions

In this article, unless the context otherwise requires:

1. "Advanced Air Mobility" means an air transportation system that primarily uses an electric aircraft, including eCTOL, eVTOL and powered lift aircrafts, to carry passengers or cargo in an urban or a regional area.

2. "ECTOL" means an electric conventional takeoff and landing aircraft.

3. "EVTOL" means an electric vertical takeoff and landing aircraft.

4. "Powered lift aircraft" means a heavier-than-air aircraft that is capable of vertical takeoff, vertical landing and low-speed flight and that primarily uses engine-driven lift devices or engine thrust for lifting the aircraft during a takeoff and at least one nonrotating airfoil for lifting the aircraft during horizontal flight.

5. "Vertiport" means an area of land or water or a structure that is primarily used for the takeoff or landing of a powered lift aircraft, including ASSOCIATED buildings or facilities. END_STATUTE

START_STATUTE28-9002. Vertiport and electric aviation planning

The department shall:

1. Develop a statewide plan or update the statewide aviation plan to include vertiports and electric aircraft charging stations and the infrastructure needs of advances in aviation technology.

2. Designate a person who has expertise in advanced air mobility within the department as a resource for local and regional jurisdictions that are developing or implementing advances in aviation technology, including an electric powered LIFT aircraft and electric aircraft.

3. provide educational materials to local and regional decision-makers on the benefits of electric POWERED lift aircrafts and the ADVANCEMENTS in aviation TECHNOLOGY.

4. Provide local and regional JURISDICTIONS with a guidebook and technical resources to support uniform planning and ZONING requirements across this state RELATED to powered lift aircraft, ELECTRIC aircrafts and advances in aviation technology. END_STATUTE

START_STATUTE28-9003. Preemption of local ordinance

A. A political subdivision of this state or an entity within a political subdivision of this state may not enact any ordinance, regulation or rule relating to advanced air mobility, the ownership of an advanced air mobility aircraft or the aerial OPERATION of an advanced air mobility aircraft.

b. NOTWITHSTANDING subsection a of this section, a POLITICAL subdivision of this state that controls or owns an airport may enact ORDINANCES, regulations or rules to govern the following actions that occur within the geographic boundaries of the airport in which the political subdivision controls:

1. the operation of an advanced air mobility aircraft.

2. The takeoff or landing of an advanced air mobility aircraft.END_STATUTE

START_STATUTE28-9004. Applicability

This Article applies only to electric aircrafts, including an ecTOL, eVTOL and a powered lift aircraft, That have both of the following:

1. A gross takeoff weight of three hundred pounds or more.

2. The capability of carrying passengers as defined in section 28-8201 or cargo. END_STATUTE
